धनवापसी पासबुक और जूरी कोर्ट में से कौनसा क़ानून देश के लिए ज़्यादा ज़रूरी है ?
.
मेरे विचार में, धनवापसी पासबुक जूरी कोर्ट की तुलना में ज्यादा जरुरी क़ानून है। यह इतना जरुरी है कि यदि इन दोनों में से कोई एक क़ानून गेजेट में छापना हो पहले धनवापसी पासबुक को छापा जाना चाहिए। जूरी कोर्ट का इसके बाद में आता है। यदि जूरी कोर्ट देश में लागू हो जाता है, किन्तु धनवापसी पासबुक गेजेट में नहीं आता है तो जूरी कोर्ट निष्फल हो जाएगा।

कैसे ?
.
(1) हमें जूरी कोर्ट क्यों चाहिए ?
.
जूरी कोर्ट पुलिस, जजों, सरकारी अधिकारियों एवं नेताओं के भ्रष्टाचार में कमी लाएगा।
.
(1.1) हमें पुलिस एवं जजों का भ्रष्टाचार दूर करने की जरूरत क्यों है ?
ताकि हम भारत में बड़े पैमाने पर कम लागत में बेहतर तकनिकी उत्पादन करने वाले छोटे एवं मझौले कारखानों की श्रंखला* खड़ी कर सके.

(*) इसके लिए हमें जीएसटी हटाकर रिक्त भूमि कर लाने की भी जरूरत होगी। रिक्त भूमि कर आये बिना जमीन सस्ती नहीं होगी और कारखाने नहीं लग पायेंगे। और यदि जीएसटी नहीं हटाया गया तो जीएसटी छोटी इकाईयो को बाजार से बाहर कर देगा।
.
(1.2) हमें भारत में कम लागत में बेहतर तकनिकी उत्पादन करने वाले छोटे एवं मझौले कारखानों की श्रंखला क्यों चाहिए ?
.
ताकि हम भारत में बड़े पैमाने पर स्वदेशी तकनीक आधारित आधुनिक हथियारों का उत्पादन कर सके। तकनिकी उत्पादन करने वाले ये छोटे कारखाने हथियार निर्माण का आधार बनायेंगे।
.
(1.3) हमें बड़े पैमाने पर स्वदेशी तकनीक आधारित आधुनिक हथियारों का उत्पादन करने की जरूरत क्यों है ?
.
ताकि हम दुश्मन देश की सेना को अपने खनिज एवं प्राकृतिक संसाधन लूटने से रोक सके। यदि हमने खुद के हथियारों का उत्पादन नहीं किया तो निम्नलिखित में से कोई एक या सभी स्थितियां घटित होगी :
.
या तो चीन हमारे प्राकृतिक संसाधन, खनिज लूट लेगा और हमारी अर्थव्यवस्था पर कब्ज़ा कर लेगा।
या "चीन से बचाने" के एवज में अमेरिका हमारे प्राकृतिक संसाधन, खनिज लूटकर हमारी अर्थव्यवस्था कब्ज़ा लेगा।
या चीन एवं अमेरिका दोनों मिलकर हमारे खनिज एवं अर्थव्यवस्था को शांति प्रिय तरीके से आपस में बाँट लेंगे।
.
लेकिन इस पूरी प्रक्रिया में सबसे महत्त्वपूर्ण बात यह है कि, बड़े पैमाने पर तकनिकी उत्पादन करने वाले कारखानो का ढांचा खड़ा करने के लिए हमें कच्चा माल यानी खनिज की जरूरत होती है। यदि कोई देश खनिज के लिए आयात पर निर्भर हो जाता है तो कारखानों को कच्चा माल महंगा मिलेगा, और लागत बढ़ जाएगी।
.
लागत बढ़ने से माल नहीं बिकेगा, और धीरे धीरे कारखाने बंद हो जायेंगे। अब जूरी कोर्ट इन कारखानों को बचा नहीं सकता। क्योंकि जूरी कारखाना मालिको की रक्षा पुलिस एवं जजों से कर सकती है, न्याय दे सकती है, स्वस्थ प्रतिस्पर्धा का ढांचा मुहैया करा सकती है, किन्तु जूरी कारखाना मालिको को सस्ते में कच्चा माल लाकर नहीं दे सकती !!
.
और यहाँ धनवापसी पासबुक की भूमिका आती है
.
(2) धनवापसी पासबुक आने का क्या प्रभाव होगा ?
.
धनवापसी पासबुक भारत में जारी खनिज एवं प्राकृतिक संसाधनों की लूट को रोक देती है। इस क़ानून के गेजेट में आने से भारत सरकार के नियंत्रण में मौजूद सभी खनिज, प्राकृतिक संसाधन, जमीन आदि 135 करोड़ भारतीय नागरिको की संपत्ति घोषित हो जायेगी।
.
जब भारत आजाद हुआ था तो जवाहर लाल के नेतृत्व में सरकार ने हमारी इस संपत्ति को अपने कब्जे में ले लिया था। तब से नागरिको की यह संपत्ति सरकार के नियंत्रण में है, और वे पिछले 70 वर्षो ने इसे चिल्लर दामों बेच बेचकर पैसा बना रहे है। धनवापसी पासबुक नागरिको के हाथ में आने से हमारे खनिज बच जायेंगे। और जब हमारे खनिज बचेंगे तभी हम इतनी ताकतवर सेना खड़ी कर पायेंगे कि चीन एवं अमेरिका की सेनाओं का मुकाबला कर सके।
.
तो हमें सेना चाहिए ताकि हम अपने प्राकृतिक संसाधनो को लुटने से बचा सके।
और सेना खड़ी करने के लिए हमें खनिज चाहिए। और धनवापसी पासबुक हमारे खनिज बचाती है, ताकि हम अपनी सेना खड़ी कर सके।
.
खनिज एवं प्राकृतिक संसाधन किसी भी देश की रीढ़ की हड्डी होती है। यदि हमारी रीढ़ टूट गयी तो जूरी कोर्ट, रिक्त भूमि कर आदि क़ानून कोई निर्णायक बदलाव नहीं ला पायेंगे। मतलब यदि हमें खनिज गँवा दिए तो भारत अफ़्रीकी देशो की तरह हमेशा के लिए कंगाल हो जायेगा।
.
(3) यदि जूरी कोर्ट आता है, किन्तु धनवापसी पासबुक नहीं आ पाती है, तो क्या हम अपने खनिज बचा पायेंगे ?
.
खनिज बचाने के संघर्ष का रास्ता बहुधा युद्ध की और जाता है। जूरी कोर्ट आने के बावजूद खनिजो की लूट जारी रह सकती है, क्योंकि धनवापसी पासबुक के अभाव में नागरिक संघर्ष करने या युद्ध में जाने से इंकार कर सकते है। उदाहरण के लिए :
.
(3.1) 1951 में ईरान का तेल अमेरिकी-ब्रिटिश कम्पनियां चिल्लर दामों में खोद रही थी। मूसादेक (Musaddeq) ने इस लूट को रोकने के लिए मुहीम चलायी गयी और 1951 में खनिज के राष्ट्रीयकरण का आदेश गेजेट में भी छाप दिया गया था। मूसादेक ईरान के प्रधानमंत्री बने। और उन्हें हटाने के लिए अमेरिकी-ब्रिटिश कंपनियों द्वारा सैन्य विद्रोह करवाया गया।
.
इस तरह ईरान में ही कार्यकर्ताओ / नेताओं के दो गुट बन गए थे। एक गुट अमेरिकियों की तरफ था और एक मूसादेक की तरफ। किन्तु नागरिको ने मूसादेक का साथ देने यानी अपने तेल को बचाने के लिए लोड उठाने से इनकार कर दिया था। नतीजा यह हुआ कि मूसादेक को बल प्रयोग द्वारा अपदस्थ करके जेल में डाल दिया गया और ईरान का तेल फिर से अमेरिकी-ब्रिटिश कंपनियों के कब्जे में चला गया !!

तो ईरान के नागरिको ने लोड उठाने से इनकार क्यों कर दिया था ?
.
क्योंकि उन्हें लगता था कि, इस तेल की लड़ाई से हमारा क्या लेना देना है !! मूसादेक की सरकार निकाले या अमेरिकी कम्पनियां निकाल ले। इससे हमें कौनसा लाभ-हानि होने वाला है। हमें तो अपना रोजगार देखना है। यदि खनिज को ईरान के नागरिको की संपत्ति घोषित कर दी जाती तो स्थिति पलट जाती। तब एक आम ईरानी नागरिक यह साफ़ तौर पर देख सकता था कि यदि हमने अपना तेल बचा लिया तो मुझे निजी तौर पर फायदा होगा, वर्ना मुझे वास्तविक वित्तीय नुकसान होगा।
.
(3.2) इसी तरह जब इंडोनेशिया में 70 के दशक में सुकर्णो ने खनिजो का राष्ट्रीयकरण करके अमेरिकी कम्पनियों को देश से बाहर कर दिया तो सीआईए के सहयोग से इंडोनेशिया के जनरल ने सैन्य विद्रोह किया। तब अमेरिकी-ब्रिटिश धनिकों ने इंडोनेशिया की सेना की मदद से 1965 से 1966 के बीच सुकर्णो की पार्टी के 10 लाख लोगो का कत्ले आम किया। पार्टी के सभी नेताओं, कार्यकर्ताओ और समर्थको को ढूंढ ढूंढ कर मौत के घाट उतारा गया। वे ऐसा कर पाए क्योंकि इण्डोनेशिया के आम नागरिको ने खनिज बचाने के लिए लोड उठाने से इनकार कर दिया था !!
.
आम नागरिको का मानना था कि इस सब लड़ाई झगड़े से हमें क्या नफा-नुकसान है। खनिज ये नहीं खोदेंगे तो वो खोद लेंगे। इससे हमें क्या फर्क आता है !! ये खनिज सरकार के है, मेरे नहीं। मुझे इस झगड़े में क्योकर जाना चाहिए।

(3.3) ब्रिटिश भारत को इतने लम्बे समय तक क्यों लूट पाए ?
.
इसकी एक वजह यह भी थी कि आम नागरिको को लगता था कि पहले राजा का राज था और अभी कम्पनी का। हमें इधर भी लगान देना है, और उधर भी, और जो खनिज वे निकाल रहे है, उससे हमारा क्या लेना देना है। ये लड़ाई तो राजा की है। और जब लगान ज्यादा बढ़ा और दमन होने लगा तो उन नागरिक समूहों ने आवाज उठाना शुरू किया जिन्हें नुकसान हो रहा था। उदाहरण के लिए 57 के विद्रोह में सैनिक और किसान आंदोलनों में किसान शामिल हो रहे थे। आम नागरिको की सहभागिता काफी कम थी।
.
और इसी स्थिति को आप आज भी देख सकते हो। नागरिक रोज खबरों में देखते है कि सरकार लगातार देश की राष्ट्रिय संपत्तियां एवं खनिज संसाधन (विनिवेश, निजीकरण, आर्थिक सुधार, कड़ा कदम, कठोर फैसला आदि के टेग लगाकर) बेच रही है। लेकिन आम नागरिक को इससे कोई लेना देना नहीं होता। आम नागरिक इस बात को साफ़ तौर पर समझ नहीं पाता कि सरकार ने घूस खाकर उसका सामान बेच दिया है।
.
इस पासबुक के हाथ में आने के बाद जब नागरिक को मालूम होगा कि कोयले का भाव 2000 रू टन है और टाटा झारखंड में 1 रू प्रति एकड़ की रोयल्टी की रेट पर असीमित कोयला खोद रहा है तो उसे निजी तौर पर नुकसान होगा। क्योंकि तब हर महीने आने वाली राशि में से कुछ राशि कम हो जाएगी !! और तब खनिजो की लूट रोकने के लिए प्रत्येक नागरिक संघर्ष करने के लिए तैयार होगा।
.
किसी भी देश में राजनैतिक समस्याओं पर ध्यान देने वाले कार्यकर्ताओ की संख्या 2-3% से ज्यादा नहीं होती। हालांकि यह संख्या भी कोई भी बदलाव लाने के लिए काफी होती है। किन्तु खनिजो को बचाने की लड़ाई का पैमाना इतना बड़ा है, और प्रतिद्वंदी इतने ताकतवर है कि बिना नागरिकों के सहयोग से किसी देश के खनिज बचा ले जाना काफी दुष्कर कार्य है। कार्यकर्ता तभी इन्हें बचा सकेंगे जब नागरिक भी यह लोड उठाने को तत्पर। और नागरिक राजनैतिक मामलो में सिर्फ तब लोड लेने को तैयार होते है जब इससे उनका नफा-नुकसान सीधे तौर पर जुड़ा हो।
.
जहाँ तक भारत के कार्यकर्ताओ की बात है, यह बात साफ़ है कि भारत के कार्यकर्ता धनवापसी पासबुक के कानून को उतनी गंभीरता से नहीं ले रहे है, जितना कि उन्हें लेना चाहिए। बहरहाल, मेरा मानना है कि भारत के सूचित कार्यकर्ताओ को खनिजो की लूट को गंभीरता से लेना शुरू कर देना चाहिए। जो कार्यकर्ता गरीबी कम करने एवं भुखमरी ख़त्म करने की समस्याओं पर काम कर रहे है, उन्हें भी इस क़ानून को गेजेट में छपवाने के लिए प्रयास करने चाहिए। क्योंकि इस क़ानून का एक प्रभाव यह है कि इससे गरीबी तेजी से कम होगी।
.
(4) धनवापसी पासबुक जारी हो जाती है, लेकिन जूरी कोर्ट लागू नहीं होता तो क्या हम अपने खनिज बचा पायेंगे ?
.
हाँ, बिलकुल बचा सकते है। एक बार यदि भारत के प्रत्येक व्यक्ति के हाथ में धनवापसी पासबुक आ जाती है, तो खनिज रोयल्टी एवं सरकारी भूमि से आने वाला किराया प्रतिमाह उनके खाते में सीधे जमा होने लगेगा। और तब यदि अपने खनिज बचाने के लिए उन्हें संघर्ष करना पड़ता है तो उनके पास इसकी वाजिब वजह होगी।
.
यदि युद्ध की नौबत आती है तो नागरिक एवं कार्यकर्ता त्वरित उपाय के तौर पर हथियारबंद सज्जन नागरिक समाज (Weaponnization of Law Abide Citizens) जैसे क़ानून छपवाकर खुद को हथियारबंद कर सकते है, ताकि वे खनिज बचाने की लड़ाई लड़ सके।
.
किन्तु यदि नागरिको के पास धनवापसी पासबुक नहीं हुयी तो हथियार होने के बावजूद उनके पास लड़ाई लड़ने की कोई जायज वजह नहीं होगी।
.
अत: मेरे विचार में धनवापसी पासबुक का कानून जूरी कोर्ट, रिक्त भूमि कर, वोट वापसी पासबुक आदि सभी कानूनों से ज्यादा महत्त्वपूर्ण है। क्योंकि यदि धन वापसी ही नहीं रही तो तो वोट वापसी करके क्या हासिल होने वाला है !!
.
(5) धनवापसी पासबुक क़ानून का सार :
.
इस कानून के गेजेट में प्रकाशित होने के साथ ही भारत के नागरिक देश की सभी खदानों, स्पेक्ट्रम, IIM अहमदाबाद को शामिल करते हुए सभी IIM के भू-खंडो, जेएनयू के भू-खंडो, यूजीसी द्वारा पोषित सभी विश्वविद्यालयों और महाविद्यालयों जिनका स्वामित्व निजी कंपनियों या ट्रस्टो के पास नहीं है, के भू-खंडो को संयुक्त और समान रूप से भारतीय नागरिकों के स्वामित्व की संपत्ति घोषित करते है।
.
अब से ये भू-खंड भारत की राज्य सरकार या भारत की केंद्र सरकार या किसी अन्य सरकारी पक्ष या निजी पक्ष की संपत्ति नहीं है। भारत के सभी अधिकारीयों, प्रधानमंत्री, हाई कोर्ट एवं सुप्रीम कोर्ट के न्यायधीशो से विनती की जाती है कि, भारत के नागरिको के उपरोक्त फैसले के विरुद्ध कोई भी याचिका स्वीकार ना करे ।
.
इस क़ानून के गेजेट में छपने के 30 दिनों के भीतर प्रत्येक मतदाता को एक धनवापसी पासबुक मिलेगी। तब भारत की केंद्र सरकार को होने वाली खनिज रॉयल्टी, स्पेक्ट्रम रॉयल्टी और केंद्र सरकार द्वारा अधिगृहीत जमीनों के किराये से प्राप्त राशि का 65% हिस्सा भारत के नागरिकों में समान रूप से बांटा जायेगा, और हर महीने यह धनराशि सीधे आपके बैंक खाते में जमा होगी। शेष 35% हिस्से का उपयोग सिर्फ सेना में सुधार के लिए खर्च होगा। जब आप राशि प्राप्त करेंगे तो इसकी एंट्री धन वापसी पासबुक में आएगी।
.
यह कानून ऐसा कोई वादा नहीं करता कि आपको प्रति महीने 500 रू या 1000 रू या कोई स्थिर राशि प्राप्त होगी। यदि खनिजों / स्पेक्ट्रम का या जमीनों का बाजार मूल्य बढ़ता है तो आमदनी और किराया बढ़ सकता है। लेकिन यदि खनिज आमदनी और किराया घटता है तो नागरिकों को हर महीने मिलने वाली यह राशि भी घटेगी। लेकिन इस कानून के लेखको का मानना है कि मौजूदा खनन एवं अंतराष्ट्रीय कीमतों के हिसाब से प्रत्येक नागरिक को लगभग 400 से 500 रू मासिक की प्राप्ति हो सकती है।
.
राष्ट्रीय खनिज अधिकारी (NMRO=National Mineral Royalty Officer) के पास खनिज रॉयल्टी और सरकारी जमीनों का किराया तय करने, इकठ्ठा करने और सभी नागरिकों के बैंक खातों में जमा करने हेतु आवश्यक कर्मचारी एवं अधिकार होंगे।
.
NMRO की नियुक्ति प्रधानमन्त्री करेंगे, किन्तु यदि यह धनराशि आपको समय पर नही मिल रही है या अन्य किसी वजह से आप NMRO को नौकरी से निकालकर किसी अन्य व्यक्ति को इस पद लाने के लिए अपनी राय दर्ज करना चाहते है तो आप धन वापसी पासबुक के साथ पटवारखाने में जाकर अपनी स्वीकृति दर्ज करवा सकेंगे। आप अपनी स्वीकृति SMS, ATM या मोबाईल एप से भी दे सकेंगे।
.
इस कानून के पारित होने के बाद यदि राष्ट्रीय खनिज अधिकारी या उसका स्टाफ कोई गबन-घपला-लापरवाही भ्रष्टाचार करता है या अन्य किसी मामले में उनकी कोई भी शिकायत आती है और यदि आपका नाम वोटर लिस्ट में है तो आपको जूरी ड्यूटी के लिए बुलाया जा सकता है। जूरी ड्यूटी में आपको आरोपी, पीड़ित, गवाहों और दोनों पक्षों के वकीलों द्वारा प्रस्तुत तथ्य-सबूत आदि देखकर बहस सुननी होगी और सजा / जुर्माना या रिहाई का फैसला देना होगा।
.
यह कानून सिर्फ केंद्र सरकार के अधीन आने वाली खदानो, स्पेक्ट्रम और जमीनों पर लागू होगा। किन्तु केंद्र सरकार के अधीन जल संसाधन इस क़ानून के दायरे से बाहर रहेगें। यह कानून राज्य, नगरपालिकाओं, जिले, तहसील, ग्राम पंचायतों के अधिकार में आने वाली खदानों और जमीनों पर भी लागू नहीं होगा।
