National Judicial Appointment Commission --- a loud meow, that replaces "committee of 3 cronies appointing judges" to "committee of 6 cronies appointing judges" !!! As always, SoMoKe-andhbhagats and CoBhApSwaRa-workers wasted everyone's times.
.
In 1991, elitemen asked SCjs to issue a ruling that SCjs will appoint SCjs, HCjs will will appoint HCjs and Ministers' role will be no more than that of a clerk carrying file from SCjs to President and back. The SCjs used to form committee of 3 crony judges, who would meet in a dark smoke filled room and decide the names of new incoming judges. The NaMo-fanboys told us all that lion NaMo will roar loudly and dismantle this cronyism in appointment of judges.
.
Well, all we hear a loud meow.
.
NaMo's NJAC says that along with three cronies from SCjs, three more cronies appointed by PM will meet in a closed dark smoke filled room and decide names of income judges !!! As if desi-videshi elitemen who have been managing three cronies cant manage six cronies !!!
.
The problem at hand is rampant corruption in judges, rampant nepotism in judges, judge-lawyer nexuses, judges nexuses with theur family member lawyers etc etc. This problem has been there since 7000 BC and isnt new one. How did USA reduced the mess? .
.
1. The judges at district level are elected, and recllable, and elected are contested by individuals and NOT parties, and so party image or party loyalty plays no role, and only individuals' merits are seen.
.
2. The district judges are also recallable by popular votes, and so they cant become rampant.
.
3. In addition, police chief and public prosecutors are mostly elected and recallable..
.
4. In some states,. ALL judges except Federal judges are elceted and recallable. eg in Texas and Calif, all judges from Magistrates to High Court Chief judges are elected and recallable !!
.
5. if a judge isnt elected, , then he is nominated by President/Governor/Mayor and approved or rejected by Senators/MLAs/Concilors. . So process is much worse than election, but less bad than 3 cronies or 6 cronies appointing judges.
.
6. Lower courts have Jury System. So judges powers are drastically reduced.
.
The SoMoKe-andhbhagats and CoBhApSwaRa-workers were shouting loud before may-2014 that SoMoKe will reduce cronyism in appointment of judges. Well folks, see for yourself. All NaMo did was that he replaced gang of 3 cronies aka collegium with a gang of 6 cronies called as commission !!! And all AK proposes is that cronies should be full time, and some 7 in numbers !! Thats all. Other than superfcially difference, what difference do you see in SoMoKe? NONE !!
.
The solution I propose is that we should demand to MPs to print law-drafts such as TCP in Gazette, and using them we should further law-drafts such as Jury System, election in judges, RTR over chief judges,, recruitment of non-chief judges by written exams only, RTR over Public Prosecutors, RTR over District Police Chiefs etc.
.
Those who support JurySys etc should stop wasting hopes and time with with SoMoKe, SomOke-andhbhagats and ChoBhApSwaRa-workers. SoMOKe have been opposing JurySys and RTR over judges since the begining of their political careers. because they know that elitemen who pay for media campaigns dont like JurySys and RTR over judges. So SoMoKe will always oppose JurySys, sponsor intellectuals to oppose JurySys and spread disinformation about JurySys/RTR etc. and will SoMoKe will try their best to kill mobements for Jurysys, movements for RTR over judges etc. And yes, if they fail, and movement grows because of efforts of activists, then, SoMoKe will come forward to collect credit !!! eg NaMo for 12 years supported age of 18 years in Juvenile Justice Act, and when demand to reduce age kept growing due to efforts of activists, he finally came forward to collect the credit of reducing the age !!!
.
So if you want JurySys in India, RTR over judges etc changes, then please stop wasting hopes on SoMoKe, please stop wasting time with SoMoKe-andhbhagats , CoBhApSwaRa-workers etc. Please publicize the law-drafts for JurySys, RTR-judges etc. The drafts are in chap-21 of rahulmehta . com / 301.htm .
