NOTICE UNDER SECTION 35(3) OF THE B.N.S.S.

In exercise of the powers conferred under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, I, the undersigned, hereby direct you as follows:

During the investigation of Crime Register No. 368/2024, registered on 14/12/2024 at Azad Maidan Police Station under Sections 353(1)(b), 353(1)(c), and 223(b) of the Bharatiya Nyaya Sanhita (BNS), it has been found that there exist sufficient and reasonable grounds to question you in connection with the facts and circumstances related to this offence.

Therefore, you are hereby directed to remain present before me at Azad Maidan Police Station on 14/10/2025 at 11:00 a.m. without fail.

Further, you are instructed to strictly comply with the following directions:

1. You shall not commit any offence in the future.

2. You shall not tamper with, alter, or destroy any evidence related to this case.

3. You shall not threaten, induce, or promise any person acquainted with the facts of this case so as to prevent them from disclosing such facts before the police or the court.

4. You shall remain present before the court whenever required or ordered.

5. During the investigation of this case, you shall remain present punctually at the place and time directed by the investigating officer and shall fully cooperate with the investigation.

6. You shall disclose all facts truthfully without concealing anything so as to help the investigation reach its proper conclusion.

7. You shall produce all documents or other materials required for investigation before the investigating officer.

8. You shall fully cooperate if it becomes necessary to arrest any other person involved in this offence.

9. You shall strictly follow all other lawful directions given by the investigating officer.

If you fail to comply with any of the conditions or directions mentioned in this notice, you may be lawfully arrested under Section 35(6) of the BNSS, 2023.

कलम ३५ (३) बी. एन. एस. एस. अन्वये नोटीस

बी.एन.एस.एस. संहिता, २०२३ मधील कलम ३५ (३) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून, मी खाली स्वाक्षरी करणार आपणास निर्देशित करतो की, दि. १४/१२/२०२४ रोजी आझाद मैदान पोलीस स्टेशन येथे दाखल असलेल्या गु. २. क. ३६८/२०२४ भा.दं.सं कलम ३५३ (१) (ब), ३५३ (१) (क), २२३ (ब) या गुन्हयाच्या तपासा दरम्यान हे निष्पन्न झाले आहे की, या गुन्हयात तपासाच्या अनुषंगाने तथ्य आणि वस्तूस्थिती जाणून घेण्यासाठी तुमच्याकडे विचारपूस करण्यासाठी सबळ व वाजवी कारणे आहेत. त्यामुळे तुम्हास दिनांक: १४/१०/२०२५ रोजी सकाळी ११.०० वा. आझाद मैदान पोलीस ठाण्यात माझ्या समक्ष न चुकता उपस्थित राहण्याचे निर्देश देण्यात येत आहेत.

त्याचप्रमाणे तुम्हांस खालील निर्देशांचे काटेकोर पालन करण्याच्या सुचना देण्यात येत आहेत.

१) भविष्यात तुम्ही कोणताही गुन्हा करणार नाहीत.

२) तुम्ही या गुन्हयासंदर्भात कोणत्याही पुराव्यांमध्ये बदल/छेड छाड करणार नाहीत,

३) या गुन्हयाच्या तथ्यांशी परिवीत असलेल्या कोणत्याही व्यक्तीला, तो अशी तथ्ये पोलीस अथवा न्यायालयासमोर उघड, करण्यापासून परावृत्त होण्याची शक्यता आहे अशा प्रकारे तुम्ही कोणतीही धमकी, प्रलोभन, किंवा अन्य कोणत आश्वासन देणार नाहीत.

४) जेव्हा आवश्यक असेल / आदेशित करण्यात येईल तेव्हा तुम्ही न चुकता न्यायालयासमोर हजर व्हाल. ५) सदर गुन्हयाच्या तपासादरम्यान आपण निर्देशित केल्यानंतर न चुकता दिलेल्या ठिकाणी वेळेत हजर राहाल व तपासादरम्यान पुर्ण सहकार्य कराल.

६) गुन्हयाच्या तपासादरम्यान योग्य निष्कर्षापर्यंत पोहोचण्यासाठी आपण कोणतीही बाब न लपविता सर्व तथ्ये सत्यतेने उघड कराल.

७) तुम्ही तपासासाठी आवश्यक सर्व दस्ताऐवज / इतर साहित्य तपासी अधिकारी यांना उपलब्ध करून द्याल,

८) गुन्हयातील सहभागी इतर कोणत्या आरोपींना अटक करणे आवश्यक असल्यास आपण सर्वतोपरी सहकार्य कराल, ९) या व्यतिरिक्त तपासी अधिका-यांनी दिलेल्या सर्व कायदेशिर निर्देशांचे आपण काटेकोरपणे पालन कराल.

या नोटीसमध्ये नमुद कोणत्याही अटीचे/निर्देशांचे पालन करण्यात चुकल्यास बी.एन.एस.एस. संहिता, २०२३

मधील कलम ३५ (६) नुसार तुम्हांस कायदेशिर अटक केली जावू शकते.
