Over the last week or so, there has been a lot of talk about the rape and killing of a 8-year old kid in Rasana, Hiranagar (Tehsil), Kathua (District) in Jammu & Kashmir. Initially when the news broke out, I went through a couple of articles and, like most people, I was outraged. And thanks to the media, I was pretty much convinced that the accused persons were indeed the culprits. But I didn't want to jump the gun; so I decided to read all the news articles, watch as many videos as possible & read the all-important chargesheet filed by the Crime Branch before I posted my view. And I'm very glad that I took out the time (4hours a day for the past 4 days) to go through each and every word of the chargesheet and compare it with the information available in the public domain and social media.

To say that there are loopholes in the investigation is an understatement. But let's begin at the very beginning. And I'll point to the discrepancies; and also raise some fundamental questions. I'll post the relevant links for those who are interested to read further. I've also attached a video which contains clips from a variety of sources.

On 10th Jan, Asifa Banu, the 8-year old daughter of Mohd. Yousuf, had taken her horses for grazing at around 12:30pm. The horses returned back to the dhera by 4pm but Asifa was nowhere to be seen. The parents (or guardians) of the child enquired about her whereabouts and tried to track her down. Failing to find her, they lodged a complaint at the Hiranagar police station on the 12th of Jan. After a few days i.e. on Jan 17th, the dead body of Asifa was found in a nearby forest.

During the course of investigation, the Hiranagar Police Station arrested a Juvenile who confessed to murdering the victim. He stated that he held the victim in a cattle shed for 7 days i.e. from 10th to the 16th of Jan but did not rape her. On the 16th, he did attempt to rape her and then proceeded to kill the girl by strangling her with the chunni that was worn by her.

QUESTION 1: What was the motive to kidnap her? This question is very important as the juvenile DID NOT rape her for the first 6 days. So why did he kidnap a 8year old girl, keep her in his cattle shed and feed her everyday? There's not a mention of the motive in the chargesheet as far as the first investigation is concerned.

QUESTION 2: The cattle shed is surrounded by houses. Was it possible that she could have been held there for 7 days without anyone noticing her? (Watch Clip 1 in the video)

QUESTION 3: The juvenile is said to have fed the victim every day. If that is so, was human excreta and/or urine found in the cattle shed? No mention in the chargesheet.

QUESTINO 4: Is there any physical or forensic evidence to prove that the victim was held in the cattle shed? Like for eg. hair strands, fingerprints, bits / pieces of the clothes worn by her, dna evidence, etc. Once again, the details are not found in the chargesheet.

On the 23rd of Jan, the investigation was transferred to the J&K Crime Branch. Soon after, under the pretext of investigation, many Hindus were picked up randomly and tortured to obtain a confession. The locals demanded a fair and independent CBI investigation. But the demand was ignored by the state government. As a result, around 15 Hindu families migrated from Rasana towards the end of February. (Clip 2)

ALLEGATION: Hindus are carrying out rallies to protect the rapists. And the Jammu Bar association too is trying to shield the rapists.

FACT: The ones who are making this claim are wrong on multiple counts.
1. In the Indian legal system, there is something called "Presumption of innocence". It means that a person is considered to be innocent until proven guilty. So it would be totally wrong to say that the rallies are being organized to protect the rapists as the trial has just begun a few days ago (on 16th of April). The accused persons cannot be considered as criminals and rapists until it has been proven beyond reasonable doubt in a court of law. Legally speaking, the burden of proof is on the prosecution. It looks like our media and a certain section of the society who consider themselves "liberals" have already decided that the accused are guilty.

2. The rallies were carried out for a number of reasons but the most important demands were to deport Rohingyas AND to transfer the investigation of the Kathua rape/murder case to the CBI. Note that the demand was for a fair investigation; not to end it. Here's an article dating back to 15th of February & it clearly states that the locals and the Hindu Ekta Manch demanded a CBI enquiry. This was almost 2 months before the outrage seen in the whole country.

3. The bandh was called on the 11th of April 2018 for the following demands:
a. Deport illegal Rohingya & Bangladeshi immigrants.
b. Directing the officers of Tribal Affairs department to not dislocate tribals till Tribal policy is formulated.
c. Handing over the investigation of the Kathua rape / murder case to the CBI.
d. Resolution of the issues raised by the people of Nowshera, Sunderbani & Kalakote.

Here is a video which shows the lawyers and other organizers shouting "Go back, Go back, Rohingyas go back" slogan at the rally. And the head of the Jammu Bar Association explains their demands. It was at this event that the flag was waved. It was not waved to protect the rapists. (A small segment of the same video can be watched in the attached video; clip 3)

4. The daughter of the prime accused Sanji Ram has demanded that the investigation be handed over to the CBI. And if the CBI investigation uncovers conclusive proof of her father's guilt, then he should be punished. (Clip 4).

Let us now look at the conclusions reached by the second investigation team i.e. the J&K Crime Branch.

According to the chargesheet, the prime accused Sanji Ram was the mastermind of the crime. He sought the help of his nephew (the juvenile), his son Vishal, the nephew's friend Parvesh Kumar (Mannu), Special Police Officer Deepak Khajuria and four others to execute his plan and to cover-up his involvement.
.
As per the chargesheet, here's how the events unfolded: On the 7th of Jan, Deepak Khajuria purchased one strip of Epitril 0.05mg containing 10 tablets. A couple of days later, on the 9th, the juvenile and his friend Mannu bought 4 Manars (a sedative?), consumed one and kept the other 3 in his pocket. On Jan 10th, the juvenile and his friend Mannu kidnapped Asifa. As Mannu held the legs of the victim, the juvenile administered Manars’ one by one forcibly to the victim. She was then raped by the juvenile; Mannu attempted to rape her but could not do it. They then took the girl and hid her inside Devisthan under the table over two Chatayees (plastic Mats) and then covered her with two Darees (cotton thread Mats).

The next day ie 11th, two tablets of Epitril 0.05mg were given to the girl to sedate her. The juvenile then called Sanji Ram's son Vishal, told him about the kidnapping and asked him to return from Meerut in case he wanted to satisfy his lust. Vishal reached Rasana at 6am the following day (Jan 12th). At 8.30am, the victim was given 3 sedative tablets of the said drug and 3 more tablets were given to her on the next day i.e. Jan 13th. Vishal then proceeded to rape the victim. She was then taken to a nearby culvert with the intention of killing her. Deepak Khajuria raped the victim and she was killed immediately after. Her dead body was moved back into the Devisthaan for two days and on the 15th, it was dumped in the jungle. The dead body was discovered on the morning of 17th and a postmortem was conducted on the same day at 2:30pm.

QUESTION 5: The chargesheet says that the accused Deepak Khajuria wanted to buy Epitril 0.5mg tablets but as it was not available at the medical store, the shopkeeper gave him a strip of Epitril 0.05mg tablets. I googled the name of these two drugs & their concentrations. I found out that Epitril is only available in the 0.25mg & 0.5mg concentration and not 0.05mg !!!

To verify this information, I spoke to the owner of one of the most well-known medical stores in our area. He has been engaged in this line of work for more than 20 years. He confirmed that Epitril (Clonazepam) is not available in 0.05mg concentration.

I then spoke to my Mamaji, Mr. Sudheer Kumar Dundigalla, a gold-medallist in M.Pharmacy and the Director of Care College of Pharmacy, Warangal. He told me that 0.05mg would be too low; and Epitril is NOT available in the said concentration.

How could the accused persons have bought a tablet that isn't even available??!! Only 8 of the 10 tablets were used and the remaining two were found by the crime branch during the course of the investigation. So we'll know more if the pic of the strip is made public.

QUESTION 6: The chargesheet says that the victim was killed on the 13th and her body was hidden in the temple for two days. As anyone with a little common sense would know, the body BEGINS to decompose after death. How is it possible that the body was kept for a period of close to 48 hours in the temple and nobody even smelled it? Absolutely impossible.

QUESTION 7: The people of the nearby villages visit the temple every day. The diyas are lit twice every day; in the morning and evening. How could it be that the body was not spotted by any one? After all, this is a small temple with 4 windows (2 on one side; and 2 on the opposite side), a single room with no place to hide a dead-body. (Clip 5)

QUESTION 8: The festivals of Lohri & Makar Sankranti fell on the 13th & 14th of Jan. It is common knowledge that Hindus make it a point to visit temples on the occasion of festivals. The locals say that hundreds of devotees were at the temple on the 14th of Jan. What is the probability of the dead body not being discovered by such a large crowd especially after the death of the victim (rotting smell)? Locals have also said that hundreds of devotees visit the temple every Sunday; this is important as 14th of Jan was infact a Sunday. So how could it be that the body was not discovered from a single-room temple?

QUESTION 9: Why does the chargesheet not mention that there were three doors to the temple and each one could be opened with a different key? The chargesheet makes the claim that there is only one key and Sanji Ram possessed it.

Here's the relevant section of the chargesheet: "..........Devisthan which is exclusively manned by accused Sanji Ram to the exclusion of any other person of the area."

This is a white lie if you go by the statement of the locals. (Watch Clip 6)

QUESTION 10: The table found at the temple was found to be around 2 feet high & around 2.5 feet in width. Is this table big enough to accommodate a dead body of a 8 year old girl? (Clip 7)

QUESTION 11: The body was discovered in the forest nearby Sanji Ram's house. If Sanji Ram was indeed the "mastermind" that we are told he was, why did he choose to dump her body just 100 meters from his house? Why did he not dump it in the dense forest behind the temple? (Clip 8)
.
QUESTION 12: ALTERNATIVE THEORIES: Has the Crime Branch looked into other possible suspects? For eg. The famous Kashmiri activist Sushil Pandit claims that the biological parents of Asifa were dead and she was being raised by her uncle. And Asifa had some property in her name. Any sane investigation will look into the financial aspect of the crime. If indeed these claims by Sushil ji are true, then one needs to look into those who would gain / benefit in the event of Asifa's death. (Clip 9)

QUESTION 13: ALTERNATIVE THEORIES: The daughter of Sanji Ram claims that on the 16th of Jan, the police and the Bakarwals searched the very area where the body was found on the next day (17th). But no dead body was found on the 16th at the same place. So this raises the possibility that the body was dumped in the said area on the night of 16th Jan. Sanji Ram's daughter and the locals have a very interesting theory. Please watch the video. (Clip 10)

QUESTION 14: If the claim made by the locals (that hundreds of devotees were present at the temple on 14th) can be verified, then it more or less proves that there was no dead body at the temple. This raises a very disturbing question: If the dead body was not there at the temple at all, then how could the hair of the victim be found at the scene? Was it planted there?
.
Let me explain: The only piece of physical evidence that ties Asifa to the temple is a strand of hair that was said to be found at the Devisthaan. Assuming that the police already had access to Asifa's clothes, hairs, etc. (which they surely would have, as the police took custody of the body on 17th), how does one prove that the strand of hair was not planted at the site by the ones who had access to it? This is important as one needs to remember that the crime branch was brought in on the 23rd of Jan i.e. 6 days after discovering the body. And it was this team that brought the temple into the picture; not the first one.

If this line of enquiry is pursued, then it may lead to some very interesting answers.

QUESTION 15: The accused Vishal (son of Sanji Ram) is said to have arrived in Rasana on the 12th of Jan. One needs to keep in mind that Vishal is a student of B.Sc. Agriculture and was appearing for his exams on the very same day !!! How could one person be present at two different places more than 500 kms apart at the same time? There is a picture that is being shown in various news channels and being circulated on social media which clearly shows Vishal's signature on the attendance sheet. The date is 12th Jan 2018 !! If this pic is indeed genuine, then it is sufficient to acquit Vishal and cast a serious doubt on the whole investigation. The chargesheet also mentions that the CCTV footage of the examination hall has been seized and sent to FSL (Forensic Science Laboratory). Will the UNEDITED video footage be released? If released, many questions will be answered. (See pic in the first comment)

There are other facts which I haven't mentioned here like - the statements of many of the witnesses was obtained by torturing them; the witnesses revealed the extent of torture to the magistrate; the prosecution DID NOT give a copy of the full 490-page chargesheet which contains the statements of the witnesses and the evidence to the accused persons, the chargesheet mentions "investigations regarding the complete financial trail are underway", the accused have demanded narco test to prove their innocence, Vishal and his friends had been to an ATM around the said dates (the video footage of the CCTV cameras at the said ATM must be verified) etc. I chose not to elaborate on these points as the article would become too lengthy.

I hope that it is now clear that both the investigating teams have done a rather poor job. This is why the locals have been demanding a CBI investigation. The locals are NOT shielding the rapists; they are probably the only ones in the state of J&K who are interested to find the truth. Most of the media, the leftist & liberal intellectuals, have already concluded that the accused are the culprits !!! What a shame.

THE CORE PROBLEM: As with the Aarushi Talwar/Hemraj double murder case, this case has also shown us the drawbacks of the investigation agencies, hidden agendas, manufactured evidences, etc. Why is it that the police and investigation agencies indulge in such unlawful practices? In my opinion, there are two main reasons.
1. SP, Commissioner, and other heads are NOT directly elected by the citizens nor can they be recalled by the citizens. So they are neither accountable to the citizens nor do they fear them.
2. Even if the police officers / investigators are guilty, they know that they can get away by bribing the judges (yes, it happens more often than you may think).

REAL AND ONLY SOLUTION:
1. The citizens should have the power to DIRECTLY ELECT AND RECALL their SP, Commissioner, etc. This will reduce corruption and inefficiencies of the police departments to a large degree.
2. The citizens should have the power to DIRECTLY ELECT AND RECALL the public prosecutor.
3. Judge system should be replaced with Jury System to make sure our courts are free from corruption and nepotism.
4. All the documents related to all civil and criminal cases like postmortem report, crime scene photographs, witness statements to the police (text and video), depositions of the witnesses and accused in the court, etc. should be uploaded to a designated government owned website.

Please note that all of the so-called experts, political commentators, Kashmiri separatists masquerading as pro-justice like Shehla Rashid, bloggers like Dhruv Rathi, etc. have NOT proposed any SYSTEMIC SOLUTION or necessary LAW DRAFTS required to reduce the crimes against women. They only pay lip service and shout slogans. This proves that they have no intention of solving the problem.
