(C.1.1) These comments are not part of the law-draft. They are only to provide information to the activists, voters and Jurors.

(C.1.2) Summary - Once this law is printed in Gazette by CM, voters will get a procedure to expel / replace any State Govt Minister except CM and Home Minister. To replace CM, the proposed GN is RtrCM. And Home Ministry is so closely linked with CM, that separating them will disrupt CM's functioning. And If citizens want to replace Home Minister, then citizens can do so using TcpState anyway.

(C.1.4) This law needs only a State Govt Gazette Notification, which can be signed by CM. This law doesnt need any legislation in Assembly or Loksabha and doesnt need any Constitutional Amendment.

(1) [ general instruction ] The word citizen would mean a registered voter residing in the State. The word 'may' clearly means 'may or need not' and also clearly means 'not binding'. Approval filing will be open i.e. choices given by a voter, along his voter-id and name, will be visible to all, on a designated website.

(2) [ instruction to DC = District Collector] if citizen of India, (whole of India, not just State) wishes to become Minister in-charge of a Dept in State Govt such as Chemicals, Education, Transportation or any dept mentioned in the list in this GN, and he appears in person or via a lawyer with affidavit before DC, then the DC would accept his candidacy for Minister of that dept after taking filing fee twice as deposit amount for MP election.

(3) [ instruction to Talati, or Talati's Clerks ] If a citizen of India comes in person to Talati's office, pays Rs 3 fee, and approves at most five persons for the position of a specific Ministry, then the Talati would enter his approvals in the computer and would give him a receipt with his voter-id#, date/time and the persons he approved.

(4) [ instruction to Talati ] The Talati will put the preferences of the citizen on CM's website with citizen's voter-ID number and his preferences. So approval filing is open.

(5) [ instruction to Talati ] If a the citizen comes to cancel his Approvals, the Talati will cancel one of more of his approvals without any fee.

(6) [ instructions to DC, CM] DC may create a system which will send SMS feedback to the voter. And CM may create a system where approvals can be registered over ATM or over SMS.

(7) [ instructions to DC] On every 5th of month, DC may publish Approval counts for each candidate as on last date of the previous month.

(8) [ instruction to CM ] If a candidate gets approval of over 51% of all voters in the State (all voters, not just the voters who have filed approvals), and it 5% more than approval count of existing Minister, then CM may or need not expel the existing Minister and may or need not appoint the person with highest approval count as new Minister of that dept. The decision of CM will be final.

Home Ministry Departments are not covered in this GN. Only following dept come under GN, where citizens can directly replace Minister. The CM can change the list via any GN. And citizens may change the list using TcpState.

(CV.2) [ instruction to Talati or Patwari ] If any citizens want to register his opposition to this law-draft or any section or wants to register YES-NO to any affidavit submitted in above clause, and he comes to Talati's office with voter-ID and pays Rs 3 fee, Talati will enter YES/NO and give him a receipt. The YES-NO will be posted on the website of the Prime Minister.
