.
PLD.0051.RtrMinisterIndia - Right to Recall Minister in Central Govt
.
[ Comments :
.
(C.1.1) These comments are not part of the law-draft. They are only to provide information to the activists, voters and Jurors.
.
(C.1.2) Summary - Once this law is printed in Gazette by PM, voters will get a procedure to expel / replace any Central Govt Minister except PM, Home Minister and Defence Minister. To replace PM, the proposed GN is RtrPM. And Home Ministry and Defence Ministry are so closely linked with PM, that separating them will disrutpt PM's functioning. And If citizens want to replace Home Minister or Defence Minister, then citizens can do so using TcpIndia anyway.
.
(C.1.3) This law-draft refers to following proposed law-drafts -
.
(a) RtrPm
(b) TcpIndia
.
Understanding RtrPm is must to understand this law-draft. Understanding TcpIndia isnt must though. The hashes of above law-drafts are given in Appendix-I.
.
(C.1.4) This law needs only a Central Govt Gazette Notification, which can be signed by PM. This law doesnt need any legislation in Loksabha and doesnt need any Constitutional Amendment either.

(1) [ general instruction ] The word citizen would mean a registered voter residing in India. The word 'may' clearly means 'may or need not' and also clearly means 'not binding'. Approval filing will be open i.e. choices given by a voter, along his voter-id and name, will be visible to all, on a designated website.
.
(2) [ instruction to DC = District Collector] if citizen of India wishes to become Minister in-charge of a Dept in Central Govt such as Chemicals, Petro Chemicals, Education, Transportation, Railways or any dept mentioned in the list at the end of this GN, and he appears in person or via a lawyer with affidavit before DC, then the Secretary or Office would accept his candidacy for Minister of that dept after taking filing fee twice as deposit amount for MP election.
.
(3) [ instruction to Talati, or Talati's Clerks ] If a citizen of India comes in person to Talati's office, pays Rs 3 fee, and approves at most five persons for the position of a specific Ministry, then the Talati would enter his approvals in the computer and would give him a receipt with his voter-id#, date/time and the persons he approved.
.
(4) [ instruction to Talati ] The Talati will put the preferences of the citizen on PM's website with citizen's voter-ID number and his preferences. So approval filing is open.
.
(5) [ instruction to Talati ] If a the citizen comes to cancel his Approvals, the Talati will cancel one of more of his approvals without any fee.
.
(6) [ instructions to DC, PM] DC may create a system which will send SMS feedback to the voter. And PM may create a system where approvals can be registered over ATM or over SMS.
.
(7) [ instructions to DC] On every 5th of month, DC may publish Approval counts for each candidate as on last date of the previous month.
.
(8) [ instruction to PM ] If a candidate gets approval of over 43 crore voters, and it is 1 crore more than approval count of existing Minister, then PM may or need not expel the existing Minister and may or need not appoint the person with highest approval count as new Minister of that dept. The decision of PM will be final.
.
(9) [instruction to all] List of Ministies and Departments covered under this GN
.
Defence Ministry Departments and Home Ministry Department are not covered in this GN. Only following dept come under GN, where citizens can directly replace Minister. The PM can change the list via any GN. And citizens may change the list using TcpIndia.
