This law doesnt cover private lands, waters and mines / plots under State Govts and local body Govts. ]

section-4 : Deciding rents from GoI owned plots
.
[comment : Rent deciding method for long lease, which also protects productive tenants from spurious desctructive bidders, are complex. And rent revision is also complex. No simple written rules are known. So activists and voters are requested to reject this section only when they see a simpler section to decide long term rental policies. ]
.
(4.1) [ procedures for NLRO ]
.
(4.1.1) For the unused land, NLRO will divide the land in plots of appropriate sizes as he seems most profitable. His discertion will be final. If any citizen has objections, he may register his objections using 'Citizens Voice' section. Or, citizens may replace NLRO useing section-1 and section-2.
.
(4.1.2) NLRO will decide the lease lenngth for each plot. The lease lengths will be 1 year or 2 years or 5 years or 10 years or 15 years or 20 years or 25 years, as decided by NLRO. The lease length will not be more than 25 years.
.
(4.1.3) NLRO will hold auction for each plot.
.
(4.1.4) The bidders will give bids for monthly rent and lease period they want, which can be less than maximum lease period, but not more. Bids will be in (monthly rent , months lease) format. Minimum lease period will be 3 months.
.
(4.1.5) If the plot is held by an existing tenant for 5 years or more, then the total bid amount for all months must exceed at least 50% of the rent that the previous tenant has paid in past 25 years, after his first 5 years, or lesser duration if he had held plot for lesser duration.
.
(4.1.5) One person can submit multiple bids. The bids will be open.
.
(4.1.6) The weight of the bid will be Monthly_Rent / log10(Lease_In_Months). i.e. more the rent, higher the weight and longer the lease, lesser the weight. Minimum lease period will be 3 months.
,
(4.1.7) And if the plot is already occupied by a tenant for over 5 years, then deposit, or collateral, will be 50% of the rent to be paid during entire lease period or 50% of the rent paid by the tenant in past 25 years, whichever is less. Collateral can be cash or FDs or land or construction or gold bonds but nothing else.
.
(4.1.8) The NLRO will give the plot to the bid with highest weight.
.
(4.1.10) NLRO will charge 6 months rent as deposit, even if the lease length is below 6 months.
.
(4.1.11) If the plot was previously being used by any tenant, and previous tenant had filed a bid, and had lost the bid, and the now the existing new tenant wants to evacuate before his lease period ends, then the tenant will have to pay at least half rent for his remaining lease period.
.
(4.1.12) If the plot was previously unused, then the new tenant will be free to evacuate land any day and need not pay rent for more than 2 months after evacuation. The deposit will be refunded within 2 months. The minimum rent of 3 months will apply if he has held land for less than 3 month.
.
(4.2) [ procedure for NLRO ] NLRO, after first 5 years, will revise the rent every year for all plots using following method :
.
(4.2.1) NLRO will decide the "applicable zone" for each plot. The applicable zone can be ward, subward, gram or 4 sqkm area around the plot not including the plot
.
(4.2.2) NLRO will obtain the per sqmt rents of flats / offices / plots in each applicable zones using copies of the rental agreements signed in that area, and rents obtained in the auctions of govt plots. He will divide rents coming from flat/offices as rent from land and rent from construction in a proprtion uniform across India. And using this data, NLRO will calculate rent from the per sqmt land per month. This will be 'standard rent' for that plot.
.
(4.2.3) If the rent coming from a tenant is higher than standard rent of that plot, then NLRO will decrease rent by 10% for next year. And the difference between rent he is paying and standard rent will be as 'extra rent paid'. There will be no interest on 'extra rent paid'.
.
(4.2.4) If the rent comg from tenant is lesser than standard rent, then 'extra rent paid' will decrease by that amount. If extra rent paid is zero, then NLRO will decreae by 5% for next year.
.
(4.3) [ procedure for NLRO ] After the lease time is over, NLRO will hold a new auction, where in existing lease holder will get following benefits
.
(4.3.1) his weight will get multiplied by 1.1 to 1.5 depending on number of years he has paid rent in past on that plot. For below 5 years, multiplier will be 1.1. And then multiplier will increase 0.01 for every month he has occupied this land. The maximum will be 1.5.
.
(4.3.2) the competing bidder must bid for at least half the length the existing bidder is bidding for.
.
(4.3.3) the existing lease holder, if he loses the auction, will get 20% of the rent he has paid in past 25 years or less, if he was holding land for more than 5 years and less than 25 years. No interest will apply.
.
(4.4) [ procedure for NLRO ] if existing lease holder loses the auction, then he can move or sell the fixtures on that land. But he will need to vacate that land.
.
(4.5) [ procedure for NLRO ] If the plot is being used and occupied by any private or govt body (such as say Indian Institude of Management, Ahmedabad plot or JNU plot), on the day this law is passed, then NLRO will not charge rent for 3 years after passing this law. After that, NLRO will take the rents on offices, flats and plots in that ward or gram or 4 sqkm area round the plot and then calculate standard rent on the land. The rent for next 3 years will be 50% of this standard rent. The rents will be revised every 3 years, and rent may decrease but not increase for 9 years. After 12 years, for next 9 years, the rent may decrease of increase as per rules stated in clause-4.1 to clause-4.4 will apply. After 21 years, a new auction will be held using above rules.
.
(4.6) [ procedure for NLRO ] NLRO may issue new rules and by-rules to deal with deciding the rents of the Govt plots. Any of his rules can be cancelled by citizens using Citizen's Voice section or TcpIndia. Or citizens may replace NLRO using section-1 and section-2. And later, citizens may punish NLRO using TcpIndia or applicable laws such as Jury Trial. But as long as NLRO is not expelled, his decisions on deciding rents will be final.
.
section-5 : Distribution of land rent
.
(5.1) [ procedure for NLRO ] NLRO will give 34% of rent collected to Defense Minister for the purpose of strengthening Military and providing weapons and weapon-use education to all citizens.
.
(5.2) NLRO will dispatch rest of rent collected every month to the citizens of India above age of 7 years. Each citizen will get equal amount except based on age and number of children as stated in later clauses.
.
(5.3) [ procedure for NLRO ] No land rent shall be paid to child below 7 years ; the rent to citizens between 7 years to 14 years will be 1/3rd the normal and between 14 and 18 will be 2/3rd of the normal rent paid.
.
(5.4) [ procedure for NLRO ] The rent paid will be 33% higher for men above 60 years and women above 55 years ; and will be 100% higher for men above 75 years and women above 70 years.
.
(5.4) [ procedure for NLRO ] One year after this law is passed, the rent a person obtains.
.
(5.5.1) will increase by 33% if he has no kids.
.
(5.6.2) will decrease by 33% if he has more than (2 daughters, 1 son) or (1 daughter, 1 son) or 2 sons or 3 daughters and the youngest child is born 1 year after the law is passed.
.
(5.6.3) will decrease by 66% if he has more than (3 daughters, 1 son) or (2 daughters, 2 sons) or (1 daughter, 2 sons) or 3 sons or 4 daughters and the youngest child is born 1 year after the law is passed.
.
(5.7) (procedure for NLRO) NLRO will dispatch extra rent collected based on residency as follows -
.
(5.7.1) The extra rent based on domicile and residency will be given only to those who are born in that state or living in that state for over 40 years. The extra amount will apply only if rent collected from that state per person is higher than rent collected per person from India.
.
(5.7.2) The upper limit on extra rent will be equal to amount received by citizens of India. IOW, total rent recieved by a person will not be more than twice the national average. eg1 - Say rent collected from whole India is coming as Rs 600 per citizen for that month. And say rent collected from a State in that month is say Rs 1000 per citizen in that state. Then NLRO will give Rs 1000 per citizen in that State. And even if rent collected from that State is Rs 2000 per citizen or Rs 3000 per citizen, then also rent given to citizen in that state will be Rs 1200 , i.e. twice the national average only.
.
[Comment -
.
(C.2.1) Explanation - All plots owned by Central Govt, all minerals owned by Central Govt and all natural resources in every State and every district, except water, is owned equally by all citizens. Thats because all minerals and plots are in India are proceted by all citizens of India and all play equal role in its protection. And so inequality due to geo-cultural differences , then they must be wihin a limit. And this dogma doesnt apply on water as no outsider will ever invade to steal water.

.

.
[Comment -
.
(C.3.1) Similar to TcpIndia - this section is similar to TcpIndia. The citizens and actvists who have read TcpIndia need not spend time in reading this Citizens' voice section.
.
end of comment ]
.
